GoGlobal Sim Ltd Terms & Conditions
Terms and Conditions are solely for the use by Customers purchasing and using Products and Services via the GoGlobal Sim Ltd website. Please read these Terms & Conditions carefully before ordering any products or services from GoGlobal Sim.
1. Definitions.
1. “Products” – GoGlobal Sim card and any other products purchased on a pre-pay basis from GoGlobal.
2. “Rates” - Outbound/inbound international calls, internal outbound/inbound UK calls, direct inquiries, personal and premium rate numbers etc.
3. “The Customer” - the party purchasing the products or Services from GoGlobal.
4. “The Affiliate/Agent” - the party reselling the products or Services of GoGlobal.
5. “Go Global” - the registered company GoGlobal Sim Ltd.
6. “Free Roaming” - destinations which are free of charge when receiving calls.
2. Essence of the Contract.
1. No contract exists between the Customer and GoGlobal for the sale of the products until GoGlobal have received and accepted the customers order/payment and have sent confirmation by email or post to the email address or address given by the customer.
2. No contract exists between the customer and GoGlobal for the supply of the products or Services the customer may have purchased, until you access or use these products or Services,
3. Accessing the Services shall mean making an outbound/inbound or SMS (text message).Using the GoGlobal card or related products.
4. The contract is subject to the customer’s right of cancellation (see Clause 6).
5. GoGlobal may change these terms of sale without notice to the customer in relation to future sales.
3. Prices, Goods & Services.
1. The description and price of the products the customer may order will be as shown on the GoGlobal website at the time of the customer placing an order and are inclusive of VAT. Call charges are shown in £ Sterling.
2. GoGlobal Sim Ltd reserves the right to increase or decrease call charges without any prior notice. All increases or decreases will be subject to increases or decreases posted to GoGlobal Sim Ltd by their network operator and associated operators.
3. Airtime must be prepaid in advance. The customer can purchase airtime by registering a credit/debit card and using the auto top up system or by registering a credit/debit card and using the phone top up system or by purchasing top up cards via the GoGlobal web site. (Please see Top up options posted on the main web page.)
4. The products on the GoGlobal web site are subject to availability. If on receipt of the customer's order the Products are not available in stock, GoGlobal will refund or credit any monies outstanding that have been charged to the customers credit/debit card for these products.
5. GoGlobal will make every possible effort to ensure that the prices shown on their website are correct and accurate at the time the customer places an order to purchase. If an error is found, we will inform the customer as soon as possible and offer the customer the option of reconfirming the order at the correct price or cancelling said order. If the customer cancels said order due to an error in the price, GoGlobal will refund or credit any sum that has been paid or charged to the customers credit/debit card for any products purchased.
6. In addition to the price, the customer will be required to pay a delivery charge for the products, as shown in the section of GoGlobal website about delivery and refunds.
7. Payment for the Products and delivery charges can be made by any method that is shown on the GoGlobal Website at the time of order.
8. There is a minimum transaction value of £10.00 per Top Up and a maximum of £50.00 per Top Up at any one time (for on line Top Ups). For Auto and Handset Top Up, this is set at a minimum of £10.00 with a maximum of £25.00 at any one time. Any other amounts will be at the discretion of GoGlobal Sim Ltd.
9. One Number is a non geographical number which can link your home, office and mobile numbers simultaneously. One Number can only be purchased in conjunction with the GoGlobal Sim Card. One Number is owned solely by GoGlobal Sim Ltd, and will be recalled on cancellation of the Customer’s Go Global Sim Card.
10. There is no connection charge when calling from any free roaming country; however you will be charged the incoming call tariff when calling from any non free roaming country. When the customer makes a call an IOT will be charged. IOT will be charged at the incoming call rate as per our rate calculator tariff. This charge is set by the network operator of the non roaming country and not by GoGlobal Sim. IOT will be charged even if the receiver is busy or fails to answer, you will only be charged the IOT rate only. No other charges will apply if the receiver fails to answer or is busy. IOT is a roaming tax set by the networks of certain countries and is passed to the customer as a non profitable charge by GoGlobal Sim.
4. Warranties.
1. All products supplied by GoGlobal are Manufacturer warranted free from defects for 12 months from the date of order. This warranty does not affect the customer’s statutory rights.
2. This warranty does not apply to any defects in the products arising from any normal wear and tear, wilful damage, accident, negligence by the customer or any third party, or for use otherwise recommended by GoGlobal, failure to follow instructions, or any alteration or repair carried out without the approval of GoGlobal.
3. If any products supplied to the customer develop a defect while under warranty, or you have any other complaint about the products, you should notify Go Global customer services in writing at the address, fax number or email address shown below.
5. Delivery.
1. The products the customer has ordered will only be delivered to the address provided by the customer when placing an order.
2. If delivery cannot be made to the customers address given, the customer will be informed within 5 working days, and a refund or credit will be returned to the customer’s credit or debit card. Refunds will only be returned to the credit or debit card used for purchase.
3. If there is no one at the address given to accept delivery of the products, the customer will be notified of an alternative delivery date or a depot where to collect the products.
4. GoGlobal will make every effort to deliver the products as soon as possible after the customer's order has been placed and payment passed. All products are sent fully insured. The customer will be responsible for the products on delivery. We therefore recommend that the customer check that all packaging is intact and undamaged before signing for delivery of the products. If the products the customer ordered have not been received within 7 Working Days from the dispatcher's e-mail, (UK only 12 working days for overseas delivery) then the customer should notify us by e-mail quoting the order number. We will note that the order has not yet been delivered and will contact the Royal Mail or courier. We may require the customer to complete certain forms for the Royal Mail or courier as evidence that the products have not yet been received by the customer. After completing an investigation into the Non-delivery of product, GoGlobal will ensure that the customer receives a full refund to the amount paid or re place the lost products.
5. On receipt the customer will become the sole owner of the products ordered and responsible for risk, loss or damage of the GoGlobal product. If the products are damaged in transit then the customer must notify us within 7 Working Days from receipt of the products. The customer must return the products and the packaging in which the products were delivered, to GoGlobal customer services, in order for GoGlobal to claim against the courier for damage caused in transit or on route. GoGlobal will deliver to the customer, replacement products or refund to the customer in full, the price paid and refund any reasonable costs incurred for returning the products.
6. GoGlobal cannot be held responsible for the late or non delivery of single products to customers living outside of the UK and Ireland. All overseas purchases will be tracked by GoGlobal until they leave the UK. The customer may request a special delivery by contacting GoGlobal customer services. (See web site for details) Any purchases over the value of £500.00 will be sent by courier free of charge.
7. All Top ups purchased via the web site are FREE of any delivery charges.
6. Customers Right of Cancellation.
1. The customer may have the right to cancel within seven working days after the customer receives the products. A working day is any day other than weekends and bank or other public holidays.
2. To exercise your customer rights of cancellation, the customer must give written notice to GoGlobal customer services by post, fax or email, at the address, fax number or email address shown below, giving details of the products ordered, order number and their delivery address.
3. If the customer exercises right of cancellation after the products have been delivered, the customer will be responsible for the Cost of returning the products to GoGlobal customer services. The Goods must be returned to the address shown below. The customer must take reasonable care to ensure that all the products returned are not damaged and that the SIM card is fully intact, and still within the housing provided, including whilst in return transit. GoGlobal will not refund any customer who has used or damaged the SIM card. GoGlobal will test all returned SIM cards for faults and will replace any SIM cards found to be the fault of the manufacturer.
4. Once the customer has notified GoGlobal that you the customer are terminating the contract, GoGlobal will refund or credit within 30 days any sum that has been paid or charged to the customers credit/debit card for the products purchased under the terms laid out under 6.1.
5. If the customer does not return the products on request as required GoGlobal may charge a sum not exceeding the direct costs of recovering the products
7. Provision of Service.
1. The Services supplied under this agreement shall continue to be supplied for a period of 9 months (unused) following the customer’s first use of said service. Providing the customer has sufficient airtime and usage this service shall continue indefinitely until cancelled by the customer under clause 6, except in the event that this agreement is cancelled under clause 10. At the end of the unused 9 month period the Services will cease to be available to the customer and all airtime will become the property of GoGlobal.
2. The customer acknowledges that this agreement is subject to network service levels and roaming agreements that currently exist between the mobile phone networks operators and that they are outside of GoGlobal’s control.
3. Subject to 7.1 GoGlobal shall use every effort at its deposal to provide the Service at all times and warrants to the customer that their Services will be provided using all there reasonable efforts and care. The mobile network coverage is the responsibility of the roaming countries mobile network provider. GoGlobal cannot accept any responsibility or liability for poor or limited coverage. The local mobile network provider reserves the right to increase, change, add and delete any of the services provided through GoGlobal.
4. The warranty under clause 7.3 shall not apply to any third party services that the customer might access through another provider outside of the providers contracted to GoGlobal.
5. If the provision of the Services is prevented or delayed by any act or omission caused by the customer, GoGlobal shall not be liable for any costs, charges or losses sustained or incurred by you arising directly or indirectly from such prevention or delay.
6. GoGlobal cannot guarantee the delivery of SMS either inbound or outbound as text messages are not guaranteed to be delivered by any network.
7. GoGlobal may, from time to time and without notice, change the Services in order to comply with any applicable safety, regulatory or statutory requirements, providing that such changes do not materially affect the nature, scope of, or the charges of the Services provided
8. All Customers on-line account statements will be held on the system by GoGlobal Sim Ltd for a period not exceeding three months, after which time these statements will be archived, and a new quarterly period will begin
9. Customer’s requiring copies of archived online statements will be charged a £15.00 admin fee per quarterly on-line statement.
10. Statements are free to view and download within the permitted three month period, and only after the Customer has registered their account.
11. Customers are advised to download statements for there personal records on a monthly basis, GoGlobal cannot be held responsible for the loss of any archived statements.
8. Customer obligations.
1. The customer will co-operate with GoGlobal in all matters relating to the provision of the Services.
2. You will be solely responsible for providing the hardware necessary to access the Services, including but not limited to mobile handsets.
3. The customer shall under no circumstances use the Services for purposes that are illegal, immoral or improper.
4. The GoGlobal SIM card rates and tariffs assume fair usage of the Services by the customer. This includes, but is not limited to maintaining a ratio of outbound tariff enabled calls to inbound calls of more than 30% on the customers account. There is also a call to SMS policy, i.e. if it is deemed that a customer has bought the GoGlobal Sim for the use of SMS only, GoGlobal reserves the right to suspend service forthwith. In the event of fair usage not being sustained, GoGlobal reserves the right to review the rates and tariffs applied to the customer account or to terminate the Services and in this event, such termination shall be deemed to have been made by the customer. GoGlobal reserves the right to terminate without prior notice for any misuse of the product.
5. In order for the customer to receive free inbound calls, the customer must at all times maintain a balance in excess of £2.00.
6. In order for the customer to make outgoing calls, the customer must at all times maintain a balance in excess of £2.00.
7. This is not a charge and the balance will be returned to the customer on cancellation of the GoGlobal Sim service and the return of the SIM card. Regrettably, this feature is essential in order to ensure that the cost of calls and free roaming benefits remain competitive at all times.
9. Free Roaming/Fair Usage.
1. This service is for the benefit of all customers and will not be permitted to be abused (see clause 8.4). Therefore GoGlobal reserves the right to disconnect this service at any time, failure to make any outbound calls after receiving 40 inbound will result in the inbound calls being blocked, and a £5.00 fee charged for reconnection. Failure to comply will result in this service being withdrawn and the customer’s contract being terminated with all outstanding costs to be recovered by GoGlobal Sim Ltd.
2. The service will be run 24 hrs 7 days a week to the destinations posted, some destinations will run 24 hrs 5 days a week Monday through Friday (please see main web site free roaming for details).There will be a 10p incoming call tariff set for countries that only run free roaming Monday through Friday. This charge will only apply Saturday/Sunday .
10. Liability.
1. These conditions set out the entire financial liability of GoGlobal (including any liability for their acts or omissions of its employees, affiliates, agents and sub-contractors) to the customer in respect of:
(a) Any breach of this agreement;
(b) Any use made by the customer of these Services; and
(c) Any representation, statement or tortuous act or omission (including negligence) arising under or in connection with this agreement.
2. Nothing in these conditions limits or excludes the liability of GoGlobal for death or personal injury resulting from negligence or for any damage or liability incurred by you a result of fraud or fraudulent misrepresentation by GoGlobal or for any liability incurred by the customer as a result of any breach by GoGlobal of the condition as to title or the warranty as to quiet possession implied by section 2 of the Supply of products and Services Act 1982.
3. Subject to condition 9.2, GoGlobal shall not be liable for any loss of profit or any indirect, special or consequential loss (whether caused by the negligence of GoGlobal, its affiliates or agents or otherwise), which arise out of or in connection with the provision of the Services or their use by the customer.
4. GoGlobal shall not be liable to the customer or be deemed to be in breach of this agreement by reason of any delay in providing, or any failure to provide, any of GoGlobal obligations in relation to the Services, if the delay or failure was due to any cause beyond GoGlobal’s reasonable control. For the avoidance of any doubt this Includes but is not limited to any failure in the network service levels or roaming agreements referred to in condition 7.2.
5. GoGlobal's total liability to contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the provision of the Services shall be limited to the price paid for the products by the customer.
11. Termination of Service.
1. If the customer does not use the Services for a period of 9 months this agreement will terminate automatically and shall be deemed to be terminated by the customer.
2. GoGlobal shall be entitled to terminate this agreement immediately if the customer breaches conditions 8.3 or 8.4 or if any of the information the customer has provided is found to be false.
3. GoGlobal shall be entitled to terminate the Services by giving the customer not less than 15 days notice, for reasons including but not limited to any breach of the customers obligations under this agreement (which if capable of remedy are not remedied within 7 days of GoGlobal informing you of the breach) or if GoGlobal is for any reason unable to provide the Services.
4. The customer shall be entitled to cancel this agreement at any time by informing GoGlobal. On cancellation GoGlobal are under no obligation to refund the airtime that is on the customer account at the date of cancellation, unless the customer wishes to terminate within 7 working days of accessing the Services by registering the GoGlobal SIM card and purchasing airtime in accordance with clause 2 and the customer has not used the Services.
12. Affiliate /Agent.
Affiliate/Agent’s Obligations.
For the Duration of the Agreement the Affiliate/Agent shall:
1. Perform Affiliate/Agent Services for Go Global Sim Ltd;
2. Use all reasonable efforts to market and make arrangement for the sale of GoGlobal’s Sim Cards and related products.
3. Perform his/hers obligations in an expert, and diligent manner and to the best of his/hers ability.
4. Not be concerned or interested either directly or indirectly in an International Roaming SIM Card service or product other than GoGlobal's products and services.
13. Affiliate/Agent Tax Liabilities.
1. The Affiliate/Agent’s relationship to GoGlobal is that of an independent Contractor and shall have the status of a self employed person and shall be responsible for all Income Tax and National Insurance or similar taxes or contributions in respect of the consideration payable hereunder and the Affiliate/Agent hereby indemnifies GoGlobal in respect of any claims that may be made by the relevant authorities against GoGlobal in respect of Income Tax or National Insurance or similar taxes or contributions, including interest and penalties, relating to the Work of the Affiliate/Agent hereunder
2. The Affiliate/Agent agrees to be responsible for his/hers expenses and Value Added Tax.
3. Nothing in this agreement shall be deemed to create any partnerships, joint venture or employment relationships between the parties.
14.Agent Commissions.
1. The Agent will be paid the sum of £5.00 per Sim card sold through his/her Agent discount code number, monies will only be paid on completion of all successful purchases.
2. All Agent commissions will be deposited into the Agents on-line account and can be viewed by the Agent at any time.
3. When the total commission value of £100.00 or over is reached, the Agent's GoGlobal account will be transferred into the nominated Bank/PayPal account; any account balance of less than £100.00 will be carried over into the next monthly payroll.
4. All Agent commission totals which exceed £100.00 will be deposited directly into the Agent’s nominated Bank/PayPal account on the first of every month.
5. There is no set higher limit to the amount an Agent can redeem in one calendar month.
6. Affiliates to agree and sign a full and separate Affiliate contract.
15. Governing Law.
1. The Agreement shall be governed by, construed, and interpreted in accordance with English Law and Parties hereby submit to the exclusive jurisdiction of the English courts.
16. No Waiver.
1. Failure by either party to exercise or enforce any right conferred by the Agreement shall not be deemed to be a waiver of any such right nor oppose so as to bar the exercise or enforcement thereof or any other right on any later occasion.
17. Force Majeure.
1. Neither party shall be held to be in breach of its obligations under the Agreement or liable to the other party whatsoever (save for obligations to make payments under the Agreement) nor liable to the other party for any losses or damages (without limitation direct, indirect and/or consequential) which may be suffered by the other party due to any case beyond the reasonable control of the first party in the Event of Force Majeure.
2. Either party may terminate this Agreement (without penalty or damages of any kind whatsoever) in the event that an event of Force Majeure extends beyond one whole calendar month.
